1. Acceptance of Terms

By accessing and using the services provided by SaS Broward ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.

2. Description of Services

SaS Broward provides landscaping construction services including but not limited to:

  • Landscape design and construction
  • Hardscaping (pavers, patios, retaining walls)
  • Outdoor kitchen construction
  • Deck and pergola construction
  • Irrigation systems installation and repair
  • Drainage solutions
  • Tree services and storm cleanup
  • Lawn care and maintenance
  • Outdoor lighting and fire features
  • Land clearing and grading

3. Service Agreements and Contracts

Written Agreements

All landscaping and construction projects require a written service agreement or contract that will include:

  • Detailed scope of work
  • Project timeline and milestones
  • Total cost and payment schedule
  • Materials and labor specifications
  • Warranty information
  • Change order procedures

Estimates and Consultations

Free estimates and consultations are provided for informational purposes only and do not constitute a binding agreement. Final pricing may vary based on site conditions, material costs, and project modifications.

4. Payment Terms

Payment Schedule

Payment terms will be specified in your service agreement and may include:

  • Initial deposit upon contract signing
  • Progress payments based on project milestones
  • Final payment upon project completion

Late Payments

Late payments may be subject to a service charge of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. Work may be suspended for accounts more than 30 days past due.

Change Orders

Any changes to the original scope of work must be approved in writing and may result in additional charges and timeline adjustments.

5. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate property information and access
  • Obtain necessary permits and approvals (unless otherwise specified)
  • Mark underground utilities before work begins
  • Maintain clear access to work areas
  • Remove or protect personal property in work areas
  • Provide timely decisions on material selections and design changes
  • Make payments according to the agreed schedule

6. Warranties and Guarantees

Workmanship Warranty

We provide a one (1) year warranty on workmanship from the date of project completion. This warranty covers defects in installation and construction but does not cover:

  • Normal wear and tear
  • Damage from weather, acts of nature, or third parties
  • Damage from improper maintenance or use
  • Changes in soil conditions or settling
  • Plant material (covered separately under plant warranty)

Plant Warranty

Plant material is warranted for ninety (90) days from installation, provided proper care and maintenance instructions are followed. Warranty does not cover damage from weather extremes, pests, diseases, or improper care.

Material Warranties

Manufactured materials are covered by their respective manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer defects.

7. Limitations of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the total amount paid for services
  • We are not liable for indirect, consequential, or punitive damages
  • We are not responsible for pre-existing conditions or hidden defects
  • Customer assumes responsibility for underground utilities not properly marked
  • We are not liable for delays due to weather, permit issues, or circumstances beyond our control

8. Insurance and Licensing

SaS Broward maintains:

  • General liability insurance
  • Workers' compensation insurance
  • Appropriate state and local licenses
  • Bonding as required by law

Proof of insurance and licensing is available upon request.

9. Cancellation and Termination

Customer Cancellation

Customers may cancel services with written notice. Cancellation terms include:

  • Cancellation within 72 hours of signing: Full refund minus administrative costs
  • Cancellation after work begins: Payment for work completed and materials ordered
  • Custom materials and special orders are non-refundable

Company Termination

We reserve the right to terminate services for:

  • Non-payment or breach of contract terms
  • Unsafe working conditions
  • Customer interference with work progress
  • Discovery of hazardous materials or conditions

10. Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Weather conditions
  • Natural disasters
  • Government actions or permit delays
  • Material shortages or supply chain disruptions
  • Labor disputes
  • Acts of terrorism or civil unrest

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes will be resolved in the courts of Broward County, Florida.

Mediation and Arbitration

Before pursuing legal action, parties agree to attempt resolution through mediation. If mediation fails, disputes may be resolved through binding arbitration in accordance with Florida law.

12. Website Terms

Acceptable Use

When using our website, you agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Transmit viruses or malicious code
  • Interfere with site functionality
  • Harvest or collect user information

Intellectual Property

All website content, including text, images, logos, and designs, is the property of SaS Broward and protected by copyright and trademark laws. Unauthorized use is prohibited.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using our services, you consent to our privacy practices.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
